Returning a marker that was received in non working condition.

Ok to sum this up simply, I agreed to a trade.

Other member shipped first.

I received marker tested it and it did not work properly.

I paid return shipping to the address he provided.

USPS said package was missent and it returned to me in MA and it looks like it is being shipped out to him again from MA?

If for some reason it returns to me again and I have to re send him the package and USPS will not cover the shipping cost am I in the right to make him reimburse me the cost of shipping to ship the marker back to him a second time. If he refuses am I in the right to keep the marker until he complies. I am not spending another $20 on a dishonest trade.

Seems like you got scammed.
I think you should make him reimburse you, since he obviously sent you a non-working marker that I will assume was marked working.
If he does refuse, I think you should talk to BST Staff for their help, maybe Slinky can come and beat the guy's ass :P

I'd say ask for the money, and if he refuses keep the marker until he does.
