it probably will and it might even get us especially since we stiffed airsoft like that... i think we should all be supportive to both airsoft and paintball and end this whole AIRSOFT VS PAINTBALL WAR! kinda think we definably should band together as two united sports and work together as one.... i know that probably wont happen but it would be nice if we stopped all the hate and just tried to be one community....i like both sports im even going airsoft tomorrow.. although, i play paintball more...

... Annnnd the fight's back on. It looks to me like the bill's been re-written to do an backdoor ban on ALL BB guns, air rifles, paintball markers, airsoft guns, toy guns.

devices: imitation firearms.
Existing law provides that the Legislature occupies the whole
field of regulation of the manufacture, sale, or possession of
imitation firearms, as defined, and that those provisions shall
preempt and be exclusive of all regulations relating to the
manufacture, sale, or possession of imitation firearms, including
regulations governing the manufacture, sale, or possession of BB
devices and air rifles, as specified.
This bill would repeal those provisions.

Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 53071.5 of the
Government Code , as amended by Section 1 of Chapter 607
of the Statutes of 2004, is repealed.
SEC. 2. Section 53071.5 of the
Government Code , as amended by Section 35 of Chapter 178
of the Statutes of 2010, is repealed.



Here's Section 53071 of the California Government Code:

California Government Code Section 53071

It is the intention of the Legislature to occupy the whole
field of regulation of the registration or licensing of commercially
manufactured firearms as encompassed by the provisions of the Penal
Code, and such provisions shall be exclusive of all local
regulations, relating to registration or licensing of commercially
manufactured firearms, by any political subdivision as defined in
Section 1721 of the Labor Code.

California Government Code Section 53071.5

By the enforcement of this section, the Legislature
occupies the whole field of regulation of the manufacture, sale, or
possession of imitation firearms, as defined in subdivision (a) of
Section 16700 of the Penal Code, and that section shall preempt and
be exclusive of all regulations relating to the manufacture, sale, or
possession of imitation firearms, including regulations governing
the manufacture, sale, or possession of BB devices and air rifles
described in Section 16250 of the Penal Code.


As I read it, Sec. 53071 reads, "CA has a set of laws governing real firearms."

Sec 53071.5 reads, "CA Legislature has a whole different set of laws governing imitation firearms, bb devices, and air rifles described in 16700, and 16250, and those sets of laws will be separate/exclusive/all-encompasing/different from laws governing real firearms. (not including any further local laws, etc.)"

So get rid of the Gov't code that says "imitation & BB guns are governed by different laws" and you're left with, "imitation and bb guns are REAL GUNS."

I wasn't "reintroduced." It went up for a vote and failed, but they gave the author a chance to amend the bill and resubmit it. That "amendment" of the bill rewrote the entire thing to make it have a completely different purpose. Instead of trying to make airsoft and other milsim guns be painted bright colors, he's trying to overturn the state's laws governing all bb/airsoft/paintball markers and have local city/county governments pass their own laws.

"SB 798 will repeal Government Code Section 53071.5 to allow
local governments to devise their own solution the problem of
copycat firearms.

Well the current revision of the law clouds the waters a lot more than the old version did. Instead of an outright ban on ownership/sales/distribution this new version would allow local cities and counties write their own laws. That doesn't mean it will ban airsoft or bb guns or paintball outright, but it does mean that you might run into trouble if you cross city lines with any of that stuff in your car.

Wow that's a stupid reason to make a law to ban paint/bb guns; because some idiot pulled it on a cop. I'll give everyone some advice on this don't pull anything on a cop and put your hands up in the air. People get shot all the time for pulling out wallets and other stupid items from their pockets when the cops tell em to freeze. It's not the cops fault. The poor guy or gal has less than a fraction of a second to decide to shoot or not. If they choose wrong then they will be dead. A crook isn't gonna tell them " o wait this is a gun so you can shoot me". Most crooks carry small pistols that a person more than 4 feet away can't tell what it is, hence y cops fire. I'v seen a video of a cop get killed and you can't tell the guy pulled out a gun because it was so small. Buy since we live in liberal loony land and don't want to accept the fact the idiots don't do what the cop tells them they get shot we decide to blame manufactures, cops, and everyone else except the idiot that didn't freeze and stick his hands in the air.

No just make all hammer manufacturers color the heads orangeand have at least a 1 inch sponge attached to each end. Also, require a liscence for a person to use or carry a hammer that requires the holder of said liscence to attend a two day training class on hammer safety.

Ban hammers that's just silly that would be too easy and not waste enough tax payer money.

Thats how theyve done it for years. Starts with well who needs a 30 round clip? restricted to 25 well who needs a 25 round clip restricted to 18 well who needs an 18 round clip restricted to 5, thats how the government has done this stuff for years if its not stopped while its small it grows.

It was read for a second time on the CA state assembly floor on 7/7/2011. It was then ordered to be read a third time at an undecided date. Yesterday they set the date for 8/15/2011 for the third reading. At that point I believe they will be voting on it again, and hopefully it will have to go back to the state senate for reconciliation since the CA Assembly version is completely different from the CA Senate version.

Pretty much what you get when you live in a blue state with a bunch of idiots in power. Getting a handgun in NY state is a bastard. Thankfully we have not had any morons propose this horse crap yet.

Pretty much what you get when you live in a blue state with a bunch of idiots in power. Getting a handgun in NY state is a bastard. Thankfully we have not had any morons propose this horse crap yet.

Okay, current status update:

The bill still hasn't passed, nor died yet. On 7/7/11 It was ordered to be read a third time in front of the Assembly on 8/15 (Monday) but they didn't get to it in time, so it's been sitting in a file waiting to be read. It was item #51 on today's agenda, which they did not get to in time, before they adjourned until Monday 8/22.

hurts milsim and airsoft not really effecting me but i still oppose it. that kid deserved to be shot, pulling out what looks like a gun on a police officer.

Problem is Normal paintball guns are safe till they decide to ban them two

the people proposing and supporting these bills are not right in the head

Amended again in committee, 8/18/2011:

SB 798, as amended, De León. BB devices: imitation
firearms.
Imitation firearms: regulation.
Existing law provides that the Legislature occupies the whole
field of regulation of the manufacture, sale, or possession of
imitation firearms, as defined, and that those provisions shall
preempt and be exclusive of all regulations relating to the
manufacture, sale, or possession of imitation firearms, including
regulations governing the manufacture, sale, or possession of BB
devices and air rifles, as specified. Existing law defines
"imitation firearm" to include a "BB device" and defines a "BB
device," for specified purposes, to include any spot marker gun.

This bill would repeal narrow those
preemption provisions to instead provide that it is
the intent of the Legislature to occupy the entire field
of regulation of spot marker guns which expel a projectile larger
than 16mm, and that no city, county, city and county, or other local
government entity may enact any ordinance or resolution prohibiting
or regulating the manufacture, sale, possession, or use of any spot
marker gun which expels a projectile larger than 16mm .
Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 53071.5 of the Government Code, as amended by
Section 1 of Chapter 607 of the Statutes of 2004, is repealed.
SEC. 2. Section 53071.5 of the Government Code, as amended by
Section 35 of Chapter 178 of the Statutes of 2010, is repealed.
SEC. 3. Section 53071.5 is added to the
Government Code , to read:
53071.5. It is the intent of the Legislature to occupy the entire
field of regulation of spot marker guns that expel a projectile
larger than 16mm. No city, county, city and county, or other local
government entity may enact or enforce any ordinance or resolution
prohibiting or regulating the manufacture, sale, possession, or use
of any spot marker gun which expels a projectile larger than 16mm.


So now it will make it so that cities/counties can pass their own bans on anything smaller than .62" (IE not paintball, but 50 cal paintball and airsoft.)
